The present Privacy Policy informs you of the procedures for collecting, processing and using your personal data (“Personal Data”) and of your rights with regard to the protection of such data.
Please read this Privacy Policy carefully before using the Site. If you do not wish us to collect your data in accordance with this Privacy Policy, please note that we will not be able to respond to some of your requests.

1. What type of Personal Data do we collect?
We collect your Personal Data only for the purposes set out in Section 3 and each time you use one of the features or services offered by the Site.
The categories and volume of Personal Data collected for the use of features and services may be updated and evolve as our services and activities change.

3. For what use do we collect your data?

When you use a QR Code or equivalent application displayed on RSRV products: we will use your Personal Data to send you more information about the products bearing the QR Code or similar application or about other products;
Subject to obtaining your consent where required, we may combine, update or consolidate your Personal Data collected via our Site with data we receive from third party and external sources. For example, we may combine purely demographic information or survey data (e.g. age, gender, family information, other interests, etc.) that is not linked to any of your Personal Data with Personal Data collected through our offers (e.g. at the time of account registration).
We may use the combined information and/or demographic information mentioned above for our internal marketing and demographic studies and for the purposes of constantly improving, personalizing and adapting the products and services we provide to you to better meet your needs. Some of the tools we use may involve automated decision-making as permitted by applicable law.
To manage and follow up your requests and comments via our “Contact us” form, in particular in connection with the performance of a contract.
We will ensure that your Personal Data remains accurate and up to date, or needs to be supplemented with additional information provided by you. We will also endeavor to avoid duplication in our database by checking each of your interactions with us and/or our affiliates and verifying whether your Personal Data remains accurate or needs to be supplemented or updated with additional information provided by you.

4. What happens if you refuse to provide us with your Personal Data?
If you refuse to submit the Personal Data requested, you may not be able to participate in certain activities, benefit from certain personalized features, or the Site and special services offered to you may be limited. For example, if you refuse to provide your e-mail address, you may not be able to receive our newsletters or register on the Site. On the other hand, you are not obliged to provide us with your Personal Data in order to browse our Site and obtain information about Mumm, RSRV and our products. In any case, we will always let you know which Personal Data is required to benefit from a service.

5. Why and to whom do we disclose your Personal Data?

For the purposes mentioned in Section 3, your Personal Information may be transferred to Pernod Ricard Group subsidiaries around the world.
To third parties
We may transfer your Personal Data to third parties, but only in the following cases:
For marketing purposes if you have given us your consent to do so.
For support purposes: We may use service providers, agents or contractors to provide us with support and maintenance services for our Site and to help us administer the Site or the various features, programs and promotions contained therein. These third parties undertake to provide your Personal Data with the same levels of security as those offered by Mumm and Pernod Ricard France ;
For joint and co-sponsored programs and promotional purposes: When we carry out joint or co-sponsored promotional activities on our Site in partnership with other companies, or other trusted third parties, and we collect and process Personal Data as part of this event, we may share your Personal Data, subject to obtaining your consent where required by law. In the event that your Personal Data is collected by, or transmitted to, a company other than Mumm or Pernod Ricard France as part of this promotion, we will inform you at the time of collection of your Personal Data;
For legal and security purposes: We may also disclose your Personal Data if we are required to do so by law or if we believe, in good faith, that such disclosure is reasonably necessary to comply with legal process, respond to claims or protect the safety or rights of Mumm or Pernod Ricard France, their customers or the public;
In the event of a merger or acquisition of all or part of Mumm or Pernod Ricard France by another company or in the event of the sale or transfer by Mumm or Pernod Ricard France of all or part of its business, the acquirer would have access to information that could include Personal Data, subject to applicable law. Similarly, some of your Personal Data may be transferred as part of a restructuring, insolvency or similar event, if permitted by and in accordance with applicable law.

6. Where, how and why may your Personal Data be transferred outside the European Union?
Given the international dimension of the Pernod Ricard Group, and for the purposes mentioned above, your Personal Data may be transferred abroad and in particular to countries that have data protection laws of a different level than the laws of the country in which you have submitted your Personal Data. It is also possible that your Personal Data may be transferred from one Pernod Ricard Group company to another and that these two companies may be located in different countries.
Mumm and Pernod Ricard France take appropriate measures to ensure the security of Personal Data, both during the transfer and at the destination, by implementing contractual clauses as prescribed by the European Commission, in accordance with applicable law.
Where our service providers for the operation of the Site are based in the United States, transfers of Personal Data to these service providers are made in accordance with applicable law and are based on standard contractual clauses, as prescribed by the European Commission, or on the Privacy Shield. These service providers are also bound by a contract that guarantees a high level of confidentiality protection and requires them (among other stipulations) to act only on instructions from Mumm or Pernod Ricard France and to constantly implement all technical measures necessary to maintain the security of your Personal Data.

7. How long do we keep your Personal Data?
We will store your Personal Data in our databases for as long as your account is active, for the duration mentioned in the contract we have concluded with you or, if necessary, to provide you with the services you request, to answer questions or solve problems or provide improved and new services. We may also retain your Personal Data in accordance with our internal retention procedures to the extent necessary to comply with our legal and regulatory obligations, to resolve disputes and to obtain performance of our contracts.
We may also retain your Personal Data after you have ceased to use the services of our Site, as required by law.

8. How do we secure your Personal Data?
Mumm and Pernod Ricard France will take all necessary technical and organizational measures to protect the confidentiality and security of your Personal Data collected via the Site. These measures include, but are not limited to: (i) storing your Personal Data in secure operating environments that are not accessible to the public and are only accessible to authorized Mumm or Pernod Ricard France personnel and our agents and contractors and (ii) verifying the identity of registered users before they can access your Personal Data.

9. What are your rights?
If your Personal Data has been processed with your consent, you have the right to withdraw your consent at any time without affecting the consent given prior to the withdrawal.
You may request access to your Personal Data.
You may request rectification of your Personal Data if it is inaccurate, incomplete or out of date.
You may request that your Personal Data be deleted if: (i) the Personal Data concerning you is no longer necessary for the purpose of the data processing, (ii) you have withdrawn your consent to the data processing based exclusively on said consent, (iii) you have contested the data processing, (iv) the processing of your Personal Data is unlawful, (v) the Personal Data must be deleted to comply with a legal obligation applicable to Mumm and Pernod Ricard France. Mumm and Pernod Ricard France will take reasonable steps to inform other entities of the Pernod Ricard Group that such erasure has been carried out.
You may request restriction of processing: (i) in the event that you dispute the accuracy of your Personal Data in order to allow us to verify such accuracy, (ii) if you wish to restrict your Personal Data rather than delete it in the event of unlawful processing, (iii) if you wish Mumm or Pernod Ricard France to retain your Personal Data because you need it to defend yourself in a legal action, (iv) in the event that you have objected to the processing but Mumm or Pernod Ricard France carries out an investigation to verify whether it has legitimate grounds for such processing that would be likely to prevail over your own rights, if the processing is based on the legitimate interests of Mumm or Pernod Ricard France.
You may request the portability of the Personal Data you have provided to us if the processing of the Personal Data is based on your consent or on the performance of a contract and is implemented in an automated manner (which excludes paper files).
You will always have the choice not to provide us with your Personal Data. In this case, you may be limited in the activities and functionalities that we will be able to provide to you.
You have the right to object to the processing of your Personal Data, at any time, for direct marketing purposes, for marketing purposes based on profiling or if the data processing is based on the legitimate interest of Mumm or Pernod Ricard France (unless we can justify the existence of a legal obligation).

11. How do we treat children’s Personal Data?
Our Site is not intended for children under the legal drinking age (“Minors”), so we do not knowingly collect any Personal Data from Minors.
